Notice and Takedown Procedure
Visibility Group Limited · Version 1.0
How to tell us about content
Everything on Acclaimedly can be reported:
- Report a recommendation, image, profile or offer: use the Report link beside it. You do not need an account.
- Report a contact message: use the link at the foot of the email it arrived in.
- Anything else, or a legal notice: write to [notices@acclaimedly.com TBC], or use the form at [/report TBC].
A useful notice tells us:
- where the content is (a link);
- why you believe it is unlawful or breaks our rules. For defamation, which statements are false or harmful and why;
- your name and email address, unless you are reporting child sexual abuse material, which you may report anonymously;
- that you believe in good faith that what you have told us is accurate and complete.
Copyright notices must also identify the work, and state that you are the owner or authorised to act for them. For the US, sign the notice and include the statements required by 17 U.S.C. §512(c)(3). Send them to our designated agent: [TBC: name, address, email].
What happens next
| When | What we do |
|---|---|
| At once | Acknowledge your notice by email |
| Within 48 hours | A person reviews it. Where it concerns defamation or a person's rights and the author is a member, we tell the author what has been said and ask for their response, without revealing who you are unless you agree |
| Within 7 days | We decide, and tell you and the author what we decided and why. Content that is clearly unlawful, threatens someone's safety, or exposes private information is hidden straight away while we decide |
| Any time | Where someone's life or safety appears to be at risk, we contact the authorities |
We may decide:
- that the content stays
- to remove it everywhere
- to restrict it only where it is unlawful
- to take action on the account under the Acceptable Use Policy
If you disagree with a decision
Whether you sent the notice or wrote the content, you can ask for the decision to be reviewed within six months, by replying to our decision email. A different person, who was not involved the first time, will review it and reply within 14 days.
If you are in the EU, you may also go to a certified out-of-court dispute settlement body (DSA Art. 21). You can still go to court in every case.
Misuse of this process
We may stop handling notices from someone who repeatedly sends notices that are clearly unfounded, after warning them. We may also suspend an account that repeatedly posts clearly unlawful content (DSA Art. 23). In the US, knowingly misrepresenting that content infringes copyright can make you liable for damages (17 U.S.C. §512(f)).
Copyright counter-notice (United States)
If your content was removed after a copyright notice and you believe that was a mistake, you can send our designated agent a counter-notice. It must contain:
- your signature
- the content's former location
- a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification
- your name, address and phone number
- your consent to the jurisdiction of the US federal court for your address, or, if you are outside the US, any judicial district in which we may be found
We forward it to the person who complained. We restore the content in 10 to 14 business days unless they tell us they have started court proceedings.
Repeat infringers
We close the accounts of members who are the subject of upheld copyright notices on three occasions within 12 months.
